Terms and Conditions - Contact List Purchase & Free Registration

Please read the terms and conditions below, which you must agree to before purchasing an email or telephone list from EmailPhoneMarketing.com. Email marketing is a new and highly innovative way of contacting large volumes of key executives; it is however governed by specific and relatively new legislation. It is important that you comply with these laws and the laws relating to direct telephone and postal marketing. You must also confirm that you have read and understood our terms and conditions, before using any or our email, telephone or postal address lists in your marketing campaigns.
Business Email & Postal Addresses
These addresses are all business email or postal addresses, they have been collected by emailing or telephoning the relevant organisation to either request or confirm the email address. The information will either be confirmed or obtained from the contact person directly or more likely that person’s PA or some other member of their staff. These are not opt-in lists and must only be used for business purposes. You must not use this information for the sale of consumer goods or services and you must comply with the relevant legislation.
Employment email addresses
These lists are comprised of email addresses for named individuals within companies that have directly recruited in the last six months. These emails exclude generic emails such as info@ or enquiries@ and are for named individuals only. These people and employers are likely to be good speculative contacts for marketing your specific talents and experiences. Some of the contacts, about 30%, also have telephone contact details. The detailed contact records would be provided as excel spreadsheets and the purchased lists would be split by salary and job type.
List & Information Usage
Our lists and any free information are supplied to you on the basis that you may use them an unlimited number of times within one year. However, you may not resell the data or otherwise supply or make it available to a third party, nor should you publish this data on any Internet website.

These lists and any free information are only provided for business purposes only. You must not use this information for the sale of consumer goods or services and you must comply with all relevant legislation.
Generic Email Addresses
Our email lists are high quality list that exclude generic email addresses such as enquiry@ or info@. They are as accurate as we can reasonably make them, based upon a 3 month update cycle, that is they are checked 4 times a year.
Excel Spreadsheets
We normally supply all lists in the form of Microsoft (MS) Excel spreadsheets, which you can import into a database or an email software package.
CTPS – Corporate Telephone Preference Service
This is the master file against which all business mailing lists must be checked. If a company is registered with the CTPS, you must not make sales calls to these CTPS registered numbers; however you may call them for market research purposes and you can mail or email them for sales purposes. It is worth stressing again that you must not under any circumstances telephone them for sales purposes.
Gone Away
“Gone-away” envelopes are those letters that are returned with a red Royal Mail “undeliverable” sticker. As each year 11% of people change employers, an expected average number in a 2 month old list would be 2%. We would like to have 0% of “gone aways”; however unless people stop changing employers, that is impossible. To deliver an effective target rate of 100% to our clients, we would normally provide an extra 2-3% of relevant contacts in any file that you order free of charge; so you will pay for say 100 records but may receive 103 contacts for the same price. If the delivery rate is less than 100 on a mailing within 4 weeks of the purchase date, we will either refund the purchase cost of the shortfall, or if you prefer offer you two new contact records for each record of any shortfall.
Email Failures
Our email lists are high quality; however your email may fail to reach the chosen destination contact for many different. It could be flagged as Spam, their server could be down, your server could be down, your server could be flagged as a Spam serve,r or their server may reject out of hours emails. There are several other technical reasons, which could affect the potential delivery of ayn email. Strangelyif you were to resend the email, it could be delivered upon a subsequent attempt. For these reasons most high volume emailings experience failure rates of 20-30%.
Technical Support
We are a data supplier and as such do not offer technical support with the actual emailing or the design of the emails; however we can refer you to a good graphics designer.
Liability
The data is based upon the information supplied to us and whilst we take reasonable steps and make reasonable efforts to ensure that the contact information is accurate and up to date; we cannot guarantee the accuracy of the data and you are contracting on the basis that you accept that we have no legal or financial liability for any inaccuracies in the data. You also accept that you are solely responsible for the consequences of your use of the data and that EmailPhonemarketing.com has no legal or financial responsibility for any adverse consequences arising from your use of the data.
